Reasonable Care or Fireproof Cigareettes

Where There’s Smoke, There’s Fire [via Popehat]

Last I remember from childhood safety lessons on the proper handling of fire and other burning materials is to keep them away from anything not specifically designed to resist or be set on fire (things like the mostly indestructable high school chemistry lab table). Apparently though, Plaintiffs think that because we don’t sell fireproof cigarettes and furniture that we should hold the manufacturers of those products liable for selling unreasonably dangerous products. As much as legal practitioners and lay people make fun of the ‘reasonable person’ and ‘reasonable care’ standards by stating “I know it when I see it,” I think this just might be the poster child for that statement.
